Terms and Conditions

  1. Customer Promise

    1. Wine – It may sound obvious, but when you order wine from us, we promise to only deliver that wine to you: we will never substitute your wine for another one. If you find that we have fulfilled your order incorrectly, please contact us and we will correct it as quickly as we can.
    2. Prices – All our prices are shown in UK pounds sterling and include Value Added Tax (VAT), unless otherwise stated.
    3. Delivery - Delivery is £6.99 per delivery, and free on orders over £150. We will deliver your wine to anywhere in the United Kingdom (including Northern Ireland, the Highlands, Scottish islands, the Isle of Man and the Scilly Isles). Delivery will generally be within 3-4 days, and within 7 working days unless otherwise agreed.
    4. Damaged or spoiled wine – In the event that any of the bottles in your case are damaged or spoiled, please let us know within 7 days. You may choose either to return the whole case or just the affected bottles for a refund. Any wines collected by our carrier must be in their original box to avoid further breakages, where possible.
    5. Availability – All of our wine is sold subject to availability, and the list of available wines can change at any time. If for any reason we are unable to fulfil your order, we will notify you immediately and fully refund any payment.

Customer satisfaction - If you are dissatisfied with our performance in any way, please contact our customer services department immediately  by email at We aim to deal with all enquiries fairly, confidentially and quickly. We will acknowledge your contact within 24 hours. We try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a satisfactory resolution has been achieved.     8. Right To Terminate - This Customer Promise is here for the good of all of our customers. If we feel that it has been abused, we reserve the right to close your account, by inactivating it, once we have met our obligations under this promise. If we do inactivate your account, and you choose to make another purchase, whether through that account or any other, then our obligation to you for any claim will be limited to your statutory rights and we will not be bound to deliver our full Customer Promise.
  2. SommelierCellar Price Guarantee

    1. In the unlikely event that you find the same wine for a lower price on another website directed at UK consumers within 24 hours of purchasing SommelierCellar, we will refund to you the difference between the two prices. The SommelierCellar Price Guarantee is subject to the terms and conditions listed below.
    2. Prices – All our prices are shown in UK pounds sterling and include Value Added Tax (VAT), unless otherwise stated. Notifying SommelierCellar of a Claim – You must email within twenty-four (24) hours of making your purchase to make a claim under the SommelierCellar Price Guarantee. The lower price must be available at the time you contact us, as determined by our customer service representatives.
    3. Must be “Like for Like” Comparison – The SommelierCellar Price Guarantee is available only for exact wine matches for the same vintage and number of bottles, including delivery costs and all applicable taxes.
    4. Comparison Rates Must Be Available to the General Public Online – The SommelierCellar Price Guarantee applies only to prices both advertised and available to the general public on a UK-based website. For example, this does not include prices offered on membership program websites, corporate discounts or rates; group, rewards program, or promotional prices; prices obtained via auction or similar process; or prices available only by using a coupon or other promotion not offered to the general public. The lower rate may not come from a website where you call to get the rate, or from an e-mail that you received. The rate must be quoted in Pounds Sterling (and without reference to currency converters).
    5. Verification of Claims – All requests are subject to verification by SommelierCellar. SommelierCellar will not accept screenshots or other purported evidence of a lower price that cannot be independently confirmed by SommelierCellar personnel. Nor will SommelierCellar verify any request that it believes, in its sole discretion, is the result of a printing or other error or is made fraudulently or in bad faith. Verified requests will receive a credit to the credit card used for the booking, within approximately 7-10 days of verification.
    6. Cancellation – If after a credit has been made pursuant to the SommelierCellar Price Guarantee the purchase is returned for a valid reason, the amount credited will be deducted from any refund made in respect of the return.
    7. Changes. SommelierCellar reserves the right in its sole discretion to modify or discontinue the SommelierCellar Price Guarantee or to restrict its availability to any person, at any time, for any or no reason, and without prior notice or liability to you. The terms that are in effect at the time of your claim will determine your eligibility under the SommelierCellar Price Guarantee. No change in the SommelierCellar Price Guarantee will affect any refund that has already been issued to you. The failure by SommelierCellar to enforce any provision of these Terms & Conditions shall not constitute a waiver of that provision.
  3. Prices and payment

    1. All prices are quoted in pounds sterling, and may be per bottle or per six bottle case, as marked. The prices include Value Added Tax, unless otherwise specified. Any delivery charges are additional.
    2. We accept payment by Maestro, Visa, MasterCard, JCB and Solo.
    3. Any discounts offered are based on previously advertised, non-discounted prices that were available for consumers to buy for at least 28 consecutive days in the previous 6 months via the web site. Where a particular wine is part of a pre-mix case with a general discount applied, the discounted price for the case is relative to the previously advertised, non-discounted prices for the constituent wines (as above).
    4. We reserve the right to terminate any special offer at any time, without notice.
  4. Age restriction

    1. We won't sell wine to anyone who isn't 18 years old or over. Sorry, but that's the law. By placing an order you confirm that you are at least 18 years old.
    2. If you are buying a case of wine as a gift - the recipient must also be over 18 years old.
    3. If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the wine is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the wine.
    4. Sorry to have to state the obvious, but once the wine has been delivered, according to your original delivery instructions, it becomes the recipient's responsibility.
  5. Security

    1. If you are nervous about shopping on the web, don't be. We use secure servers with state-of-the-art encryption and secure sockets layer (SSL) technology for the transfer of credit card information. Additionally, we have security measures in place to protect our customer database and access to this database is restricted internally.
    2. To make sure that you don't have to worry, we will make good any losses suffered by you and charged to you by your credit card company, up to a maximum of £1,000 through the unlawful use by a third party of your credit card or credit card information directly as a result of your use of our web site.

  6. Returns

    1. If some or all of the bottles of wine in a case are broken or spoiled when they are delivered you should notify us as soon as possible. You may choose either to return the whole case or just the affected bottles for a refund.
    2. You must notify us of all wines which are due to be returned for any of the reasons stated in this clause within 90 days from delivery of the wine, otherwise you cannot rely on Clause 4a above. You can contact us by email at or in writing to:

    3. All refunds and reimbursements under Clause 4a will be paid within 30 days of you notifying us of your wish to return wine under that clause, provided the wine has been collected by our carrier.
    4. Any wines collected by our carrier must be in their original box to avoid further breakages, where possible.
    5. Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misdescribed goods. Further information about your rights is available from your Local Authority Trading Standards Department or Citizen's Advice Bureau.
  7. Intellectual Property Rights

    1. You agree and acknowledge that we own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site, and to the business of SommelierCellar, including the structure, design and layout of the web site.
    2. You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.
    3. All persons, individual and corporate, are prohibited from providing hypertext or other links to the web site, other than to our home page, from their own web site or from a third party's web site, without our prior written consent.
  8. Warranties

    1. We warrant that the wines will be of satisfactory quality and fit for their general purpose. We would be happy to drink all of them ourselves.
  9. Limitation of liability

    1. Nothing in these Terms and Conditions shall exclude SommelierCellar's liability for personal injury or death caused by its negligence.
    2. We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:
    3. loss or damage was not foreseeable to both parties when the contract was formed;
    4. loss or damage was not caused by any breach on the part of the supplier;
    5. loss or damage relates to business and/or non-consumers.
    6. Subject to Clause 7a we will not be liable for loss or damage caused by the customer handling the wine. In particular we will not be liable for spillages or breakages after the wine has been delivered to the customer.
    7. Customers should also be aware of the following inherent risks and warnings:
    8. Alcohol should be consumed in moderation.
    9. A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
    10. Red wine in particular may cause staining if spilt so extra care should be taken.
    11. Sparkling wines and champagnes can be volatile due to the build up of gases. Extra care should be taken when opening these.
  10. Data Protection

    1. By providing your details to SommelierCellar on our web site, you consent to SommelierCellar maintaining, recording, holding and using the information you give us at the time of ordering to process your orders, to improve our service to you and inform you of promotions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.
    2. Sommelier Cellar Privacy Promise. We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your wine to you, e.g. our delivery company. From time to time, we may send information about discounts, free stuff and personalised offers on wine and champagne, and exclusive deals, unless you have told us not to do so by emailing us at
    3. Separate to the email communication described in clause 8b, SommelierCellar also operates an automatic newsletter to notify members of new sales. This can be unsubscribed to at any time through a link in the email, or by changing your subscription settings on our web site.

If you opt-out from hearing from SommelierCellar or third parties, you will only be contacted by SommelierCellar regarding service issues including, but not exclusively, order confirmation and delivery confirmation, significant changes to terms and conditions and informational, non-marketing emails.

  11. General

    1. We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.
    2. Sommelier Cellar may change or add to these terms and conditions for security, legal or regulatory reasons. We will not use this right to vary the terms of any special offer that applies to you.
    3. The sale of the goods takes place only when the wine is despatched from our warehouse. Until that time, no charge will be made to your credit card and Sommelier Cellar will not be bound to supply the goods at the price.
